Delhi: The Citizenship Amendment Act i.e. CAA was once a matter of considerable discussion across the country. There was a big demonstration in Shaheen Bagh in protest against this. This was a matter of December 2019. Then there were riots in the area of Jamia. In which after about five years, Saket Court of Delhi has framed charges against 12 people. In fact, on December 15, 2019, many DTC buses, private vehicles and police property were set on fire in the violence in Jamia Nagar area. Also, heavy stone pelting was also done on many officers. The court admitted that it was not a spontaneous riot, but the result of a planned plan. The court has considered the Sharjil Imam to incite violence. But 15 people have also been acquitted. Why the Sharjil Imam got stuck while other people were left out.
Why the Sharjil Imam trapped?
Saket court judge Vishal Singh said that Sharjil Imam was the mastermind, which led to massive riots, arson and violence in the protests against CAA on 15 December 2019. The court admitted that the Imam’s inflammatory and in many ways toxic speeches provoked the riots. Due to which people also came forward to take to the streets. The court said that Sharjil’s speech was going to incite hatred, due to which people of one religion stood against the other. According to the judge, the Imam deliberately used the Muslim community, disrupts the lives of the people through Chakka Jam in the name of protests against CAA.
The person fighting the case against Shaziil said that the Imam held public meetings, distributed inflammatory leaflets and used social media to influence Muslim students and workers. Also, there was a deliberate attempt to incite the speech of Sharjil at Aligarh Muslim University on December 11, 2019 and the speech of Jamia University on December 13, 2019. Here the Imam argued that he was not a part of the illegal meeting and his speech was not going to incite violence.
What streams will run on the Imam
The court has framed charges against the Imam under Section 109 IPC (provoking crime), 120B IPC (criminal conspiracy), 153A IPC (promoting enmity between groups), 143, 147, 148, 149 IPC (illegal gathering, rioting, armed riot). Also, sections 186, 353, 332, 333 IPC (attacking the work of public servants, attacking police officers), 308, 427, 435, 323, 341 IPC (non -intentional murder, mischief, attempt to fire) and have also framed charges under Section 3/4 of the law.
Who else trapped other than the Imam?
Apart from the Imam, the court also framed charges against Ashu Khan, Chandan Kumar and Asif Iqbal Tanha on charges of leading the mob and inciting violence. The court considered all these chemobile locations and media interviews as evidence. The court rejected the Imam’s argument that it had only called for a peaceful protest, stating that a large -scale flywheel jam in a city like Delhi could never be peaceful. The court also framed charges against nine more accused Anal Hussain, Anwar Kala, Yunus and Jumman. At the same time, charges can also be framed against Rana, Mohammad Harun and Mohammad Furkan. The court has also said that allegations against accused Asal Ansari, Mohammad Hanif will be decided separately.
Who were acquitted by the court?
The court surrves 15 accused -Mohammad Adil, Ruhul Amin, Mohammad Jamal, Mohammad Umar, Mohammad Shahil, Mudassir Fahim Hasmi, Mohammad Imran Ahmed Saqib Khan, Tanjil Ahmed Chaudhary, Mohammad Imran Munib Mian, Saif Siddiqui, Shahnawaz and Mohammad Yusuf. The court admitted that only mobile location data was found to establish their participation in the riots, which is insufficient. The court said that until the evidence of the man being present there, it cannot be done to blame or convict a person on the place without the location of the mobile phone.
